ZONING BOARD OF APPEALS
Meeting Minutes of September 25, 2007
Town Administration Building,
Meeting Room #1, 7:00 PM
Chairman Antonio Andre called the meeting to order at 7:15 PM. Present were regular members Norman Czech, Ingrid Thompson and Russ Brown. Also present was clerk, Mary Watson, recording minutes. Member Dennis Fountain and Alternate members Gary Doane and Walter Solzak were absent.
Finding Request for Michelle and John Larose for the property located on 2062 Pleasant Street, Three Rivers, to demolish the existing nonconforming garage and replace with a new garage that does not meet the required side and rear lot setbacks. The property is in the Town Residential zone.
The clerk read the public hearing notice.
A motion was made by N.Czech to waive the reading of the abutter list. R.Brown seconded. The vote passed (4:0).
The applicant John LaRose presented the information to the Board. Mr. LaRose advised that they are demolishing the existing garage and foundation and will replace with a new foundation. The new garage would not be following the same footprint as the existing garage.
A.Andre advised that a new foundation must be to code.
N.Czech read the Zoning Ordinance section 171.83 (4) which states that the structures are entitled to treatments as such provided that any proposed change, alteration or extension of the non-complying condition shall be subject to the provisions of the ordinance and require that form of relief which would otherwise be necessary to allow said change, alteration or expansion.
A.Andre stated that there was a similar Finding that was denied in the past and therefore he wants to speak with Town Counsel before this Finding can be approved or denied.
A motion was made by I.Thompson to continue the hearing to October 3, 2007 at 7:00 p.m. R.Brown seconded. The vote passed (4:0).
7:45 PM-Crystal Lake Village Timeline-for the property located off Fuller Road, Palmer.
Larry Rosenburg and his partner Steven Blum were present.
Mr. Rosenburg reviewed the timeline with the Board.
Mr. Rosenburg has also provided the Crystal Lake Village Condominium Trust documents, which will be reviewed by Town Counsel Michael Ciota.
A.Andre asked about the water runoff. Mr. Rosenburg advised that there is a detention pond between Ains Manor Road and Philip Road with a drainage ditch at the right side of Philip Road. The drainage ditch is 3 ½ feet deep and the road is pitched toward the drainage ditch. Sherman & Frydryk has done an inspection on the drainage ditch.
N.Czech asked if the development would cease building during the winter months.
Mr. Rosenburg advised that he is not sure if the development would cease during the winter. There is no foundation that has been built for the next building yet. He would like to sell one of the twelve units first before a new foundation would be poured.
N.Czech stated that if they are not planning on building the next unit in the next six months, then some vegetation would need to be put into the area.
Mr. Rosenburg stated that once the sewer connection is finished he would clean out the area between Ains Manor Road and the pumping station. Mr. Rosenburg would provide more information to the Board at the next meeting.
I.Thompson asked about the price range of the units.
S.Blum advised that the units are in the price range of $ 220,000-$ 250,000 and the affordable units are in the price range of $ 130,000-$ 132,000.
I.Thompson asked how much are the condominium association fees.
Mr. Rosenburg advised that the fees are $ 120.00 a month and the affordable unit fees are
$ 65.00-$ 70.00 a month.
There were no other questions from the Board.
M.Watson advised Mr. Rosenburg that the next meeting would be scheduled once Town Counsel Michael Ciota reviews the documents.
