Planning Board Minutes 08/24/09
TOWN OF PALMER
    Planning Board Meeting Minutes
August 24, 2009, 7:00 pm,
Town Administration Building, Meeting Room.

Chairman Michael Marciniec called the meeting of the Planning Board to order at
7:00 PM.  Present were members Norman Czech, Diane France, James Haley, Jr. and Thomas Skowyra.  Also present were Town Planner Linda Leduc and Principal Clerk Mary Watson recording minutes.  

7:00 PM-Finding for Sherry Granger-whose property is located on 81 Flynt Street, Palmer.  The applicant is proposing to demolish an existing mobile home and replace with a single family home.

Present were Donald Frydryk of Sherman and Frydryk Land Surveying and Engineering, the applicant Sherry Granger and Bill Gunn of the Community Development Department.

D.Frydryk stated that the applicant is proposing to reconstruct the dwelling with larger setbacks to the street and property sidelines than the existing setbacks.  The proposed dwelling will replace a 24-foot wide by 60-foot long mobile home residence with a modular single-family home 26 feet wide by 40 feet long.  The existing structure is 33 feet from the front property line and 9 feet from the property sideline.  The proposed home would be 51 feet from the front property line and 21 feet from the property sidelines.  

The property is located in the Suburban Residential zone.

M.Marciniec asked B.Gunn what role does Community Development have in the application.

B.Gunn stated that the applicant is seeking assistance from the Community Development office to rebuild a single-family home using grant money.

The Board discussed the email received on August 7, 2009 from Gerry Skowronek of the Palmer Waste Water Treatment Plant expressing the importance of proper handling of the pump grinder during construction.  

D.Frydryk stated that the existing grinder pump would be left as is with the electric to be shut off during construction and connected back upon completion.

Evelyn Anton, whose property is located on 76 Flynt Street, stated that she is concerned about the pond draining into the road and damaging the road.

A motion was made by N.Czech to issue the Finding for Sherry Granger of 81 Flynt Street.  J.Haley, Jr., seconded.  The vote passed (5:0).

7:22 PM-Special Permit for earth removal for JT Brown Nominee Trust for the property located on Ware Road, Palmer.

Present were the applicants, William and Nancy Brown.  Also present and representing the Board was Donald Frydryk of Sherman and Frydryk Land Surveying and Engineering.  Robert LeMaitre, civil engineer and land surveyor for JT Brown was not present.

M.Marciniec stated that there were three items that the Board would need to acknowledge.  They are as follows:
  • The peer review comments from Sherman and Frydryk dated August 14, 2009.
  • The rebuttal comments from Robert H. LeMaitre dated August 15, 2009.
  • The pictures submitted by William Brown.
A motion was made by T.Skowyra acknowledging receipt of all three documents.  D.France seconded.  The vote passed (5:0).

William Brown stated he had two more pictures to present to the Board that were taken on August 21 in which the Board reviewed all the pictures that were submitted.

Discussions were held regarding the slopes on the site at the area closer to Ware Road.

W.Brown requested to leave the slopes as is.

D.Frydryk stated the existing permit issued in 2008 states the incorrect ration for the slope requirement as stated in the rules and regulation of the Planning Board.

T.Skowyra stated that the faces are too steep and the Board agreed that the site should not be left in that condition at the end of the day.

Discussions were held regarding the closeout for the next year on the site.

W.Brown stated that the closeout area is towards the railroad near the Ware side and advised he is working with the railroad regarding the easement.

L.Leduc stated that if the railway were acquired, the applicant would need to file for an amendment with the Board.

W.Brown asked the Board what the procedure would be to allow crushing and screening on the site.

L.Leduc reminded the applicant that he would need to submit a letter to the Board requesting to crush and/or screen for a specific amount of time.  

L.Leduc stated that crushing and screening are allowed for closeout purposes only.

A motion was made by J.Haley, Jr., to issue the Special Permit for Earth Removal to JT Brown Nominee Trust for the property located on Ware Road.  T.Skowyra seconded.  The vote passed (5:0).

Subdivision Approval Not Required (SANR)-for the property located on 6 Deborah Street.

A motion was made by J.Haley, Jr., to approve the SANR for 6 Deborah Street.  N.Czech seconded.  The vote passed (5:0).

8:07 PM-Review of the Knox Pond amended plan for the property located on 1094 Thorndike Street, Palmer.

The applicant Ray Breton was present along with Donald Frydryk of Sherman and Frydryk.

Discussions were held regarding the colors on the plan that represent the phasing of the project.

L.Leduc stated that the noncommercial earth removal permit that was approved for Bradford Cutty would expire on June 15, 2010.  If no work has commenced, the applicant would need to re-submit.  This project is part of Phase 2A for Breton Estates.

The Board reviewed the new timeline and phasing scheduled submitted by Sherman and Frydryk.

A motion was made by D.France to issue the amended permit with conditions for Knox Pond located on 1094 Thorndike Street.  T.Skowyra seconded.  The vote passed (4:0:1).  Member J.Haley, Jr., abstained.

Knox Pond Construction Report #21-A motion was made by N.Czech acknowledging receipt of the report.  D.France seconded.  The vote passed (4:0:1).  Member J.Haley, Jr., abstained.

L.Leduc stated that the office has received many complaints from an abutter regarding the wood processing occurring on Park Street at Northern Tree.  The complaints would be forwarded to the Zoning Enforcement Officer.

8:28 PM-A motion was made by T.Skowyra to adjourn.  D.France seconded.  The vote passed (5:0).
