TOWN OF PALMER
    Planning Board Meeting Minutes
April 6, 2009, 7:00 pm, Planning Office.

Chairman Michael Marciniec called the meeting of the Planning Board to order at
7:00 PM.  Present were members Norman Czech, Diane France and Thomas Skowyra.  Also present were Town Planner Linda Leduc and Principal Clerk Mary Watson recording minutes.  Member James Haley, Jr., was absent.

There were no public hearings scheduled.

Meeting Minutes of April 1, 2009-A motion was made by N.Czech to approve the minutes of the special meeting.  T.Skowyra seconded.  The vote passed (3:0:1).  Member D.France abstained.

Meeting Minutes of March 23, 2009-A motion was made by D.France to approve the minutes.  T.Skowyra seconded.  The vote passed (4:0).

M.Marciniec stated that there is an invite from the Charter Commission in a letter dated March 26, 2009 for anyone interested in attending the meeting on Tuesday April 7 at 7:00 p.m. at the Pathfinder Regional Technical High School library.

Acknowledge receipt of Quarterly Report JJC Materials, Inc-for the property located off Park Street, Palmer.

A report dated March 27, 2009 was sent from Lycott Environmental and signed by Lee Lyman. The report indicates that as of March 27, 2009, there has been no activity on the site and activity should commence sometime in the middle of April.

Discussions were held regarding what the quarterly report should contain as stated in the earth removal permit.

L.Leduc stated that she would speak with Janet Callahan regarding the required contents of the quarterly report.

A motion was made by N.Czech requesting the Town Planner to contact JJC Materials, Inc. regarding the quarterly report.  T.Skowyra seconded.  The vote passed (4:0).

Custom Design Builders Landscape Plan-for the property located on Chamber Road, Three Rivers.

A permit was issued for the site on November 26, 2007 and amended on October 6, 2008.  

Under the amendment the applicant was required to submit a landscape plan by April 1, 2009, completion of the plantings by Fall 2009 and design details of the retaining wall.  The applicant, who was not present, had been reminded of the required landscape plan and Mr. Lemon, Sr. had advised the office that the landscaping was on the original site plan.

The Board discussed the requirement of having white pine as stated in Condition Number Two of the permit.  The Site Plan submitted by the applicant dated May 8, 2008 indicates white fur along the berm.

The plan submitted on May 8, 2008 was marked to include the addition of white pine.  The trees are to be recorded on an As Built Plan to be submitted by the applicant along with an engineered plan for the retaining wall.

L.Leduc advised the Board of a meeting with Chris Curtis from Pioneer Valley Planning Commission (PVPC) and provided a document entitled Ware River Protection and Floodplain Zoning.

The meeting was held in the afternoon of April 6 to have PVPC provide assistance on the water protection strategies.  Also discussed was reviewing the Transfer Development Rights (TDR) ordinance with changes to emphasize water protection.

Wind Ordinance-L.Leduc stated that Attorney Michael Ciota had reviewed the proposed wind ordinance.  Attorney Ciota provided changes and a sample ordinance for the Town of Fitchburg.

Discussions were held on the kilowatt regulations.  Since J.Haley, Jr., was not present, this item would be tabled.

Discussions were also held regarding Met Towers.  L.Leduc stated that she would provide more information on Met Towers to the Board.

More discussions would take place on the Wind Ordinance when all members are present.

8:15 PM-A motion was made by N.Czech to adjourn.  T.Skowyra seconded.  The vote passed (4:0).
