CONSERVATION COMMISSION MEETING
Meeting Minutes of Tuesday, December 1, 2009
Meeting Room, Town Administration Building- 7:00 PM

Chairman David Johnson called the meeting of the Conservation Commission to order at 7:00 PM.  Present were members Donald Duffy, Peter Izyk, Robert Ring, Matthew Trybus and Christine Beauregard.  Also present was Principal Clerk Mary Watson recording the minutes.  

7:00 PM-Notice of Intent for Leon Lambert for the property located at 232 Flynt Street, Palmer.  The applicant is proposing to remove a mobile home and replace with a single-family home.

The clerk read the public hearing notice.

Donald Frydryk of Sherman and Frydryk Land Surveying and Engineering was present and representing the applicant.  

D.Frydryk stated that the project includes erecting erosion controls at the limit of work along the rear of the property along with the installation of a permanent limit of work markers to restrict future activities in the buffer zone.  The proposed work also includes construction of a gravel loop drive at the front of the house.

D.Frydryk also stated that the proposed work would include 8,600 square feet of disturbance in the 100-foot buffer zone and 4,600 square feet in the 50-foot buffer zone along with 1500 square feet of disturbed buffer zone to be restored.

P.Izyk asked if the oil tank would be removed.

D.Frydryk stated that the oil tank is currently located above ground and would be removed.

A motion was made by R.Ring to close the hearing.  D.Duffy seconded.  The vote passed (6:0).

D.Duffy stated that the project is an improvement to the lot since 1500 square feet is to be restored to its natural state.

D.Frydryk asked the PCC about the permanent markers.

The PCC stated that they could use concrete bounds.

D.Frydryk suggested using 4” sonotubes as permanent markers.

The PCC agreed that 4” or 6” sonotubes could be used.

A motion was made by R.Ring to issue an Order of Conditions for Leon Lambert for the property located at 232 Flynt Street, Palmer.  P.Izyk seconded.  The vote passed (6:0).
Lessard Environmental Letter-dated November 18, 2009 was received regarding the Mapletree Industrial Center located at 21 Wilbraham Street, Palmer.

D.Johnson stated that he visited the site on November 20 and noticed a lot of soil had been removed and there were numerous flags used as markers for the soil samples that were taken at the site.

Letter from JMP Environmental-was received on November 30 and signed by John Prenosil.  The letter states that JMP Environmental Consulting, Inc. has been retained by Mr. Lizak to perform long term monitoring of replacement vegetation at Shearer Street for a period of two years.

D.Johnson stated that Mr. Lizak has paid the Enforcement Order fine of $ 6600.00 on November 23, 2009.

A motion was made by R.Ring acknowledging receipt of the letter from JMP Environmental dated November 30 and to allow JMP Environmental to be contracted with Mr. Lizak.  D.Duffy seconded.  The vote passed (6:0).

Letter from Patricia and James Poehler-dated November 30, 2009 was received regarding the Order of Conditions for 276 Flynt Street.  

The letter states that they have received, read and understand the OC and shall comply with all the orders.

Also received was the recording of the OC from the Hampden County Registry of Deeds and a letter from Brian Webster of Scantic Valley Excavating stating that he affirms the understanding of the OC for the Poehler project.

D.Frydryk spoke with the PCC regarding the Poehler OC stating that per the conditions a pre-construction conference is required with the PCC.

This pre-construction conference would be held on December 3 in the afternoon as stated by D.Johnson.

Meeting Minutes of November 17, 2009-A motion was made by M.Trybus to approve the minutes as amended.  D.Duffy seconded.  The vote passed (6:0).

The PCC discussed the recent complaint regarding A1 Transmission located at 1132 Thorndike Street, Palmer.

R.Ring stated that he had brought a Request for Determination of Applicability (RDA) application to an employee at the site two weeks ago; however there has been no response.

A letter will be written to A1 Transmission requesting that they file an RDA application and attend the next meeting.

The PCC discussed the meeting dates and have cancelled the meeting on December 15.  The next PCC meeting would be held on January 5, 2010.

R.Ring stated that he has drafted a letter to the Massachusetts Department of Transportation regarding the PCC interest in the Brainerd parcel located at Assessor’s Map 21 Parcel 8-1.

P.Izyk asked if King’s Brook has native trout, if so it should be mention in the letter to the Massachusetts Department of Transportation.

R.Ring stated he would add that information and also stated that the property is currently located in the Aquifer Protection District.

C.Beauregard stated that she has spoken to the director of the Executive Office of Energy and Environmental Affairs (EOEEA) regarding the extension for the Open Space Recreation Plan (OSRP) in which revisions would be needed to Section 5 of the OSRP.

Discussions were held regarding the committee members on the original OSRP plan, the addition and removal of projects on the current plan and the next course of action.

The deadline for the extension is February 28, 2010 as stated by C.Beauregard.

Bills:

A motion was made by R.Ring to pay for the 2006 MACC Handbook.  D.Duffy seconded.  The vote passed (6:0).

7:50 PM-A motion was made by R.Ring to adjourn.  D.Duffy seconded.  The vote passed (6:0).
