Conservation Commission Minutes 10/20/09
CONSERVATION COMMISSION MEETING
 Meeting Minutes of Tuesday, October 20, 2009
Meeting Room, Town Administration Building- 7:00 PM

Member Peter Izyk called the meeting to order at 7:05 PM.  Present were Commissioners Matthew Trybus, Christine Beauregard and Robert Ring.  Also present was Principal Clerk Mary Watson recording the minutes.  Chairman David Johnson and Vice Chairman Donald Duffy were absent.

7:05 PM-Request for Determination of Applicability (RDA)-for the property located on 1217 Thorndike Street, Palmer.

A motion was made by R.Ring to waive the reading of the public meeting notice.  P.Izyk seconded.  The vote passed (4:0).

Present was Michael Brozek of WJF Geo Consultants, Inc., who was representing Raymond Recor.

The applicant is requesting an RDA for the removal of an inactive septic system and contaminated soils located in the vicinity of the septic tank.

M.Brozek stated that the site is under a Department of Environmental Protection (DEP) order due to a recent oil spill at the property.  

M.Brozek stated that the site information number is 1-0017137.

R.Ring stated that the applicant must contact the office before starting any work so that the PCC could visit the site.

Discussions were held regarding the stockpile.  The PCC indicated that this pile couldn’t be placed near the brook.

The PCC discussed the ground water elevation and borings with M.Brozek.

M.Trybus stated that they could cover the stockpile and put hay bales around it so that there would be no runoff occurring.

The PCC stated that they would have conditions for the determination.  They are as follows:  
  • Applicant must notify the PCC prior to work being done.
  • Applicant must maintain the contaminated soils.
A motion was made by R.Ring to issue a negative determination for 1217 Thorndike Street, Palmer.  M.Trybus seconded.  The vote passed (4:0).

7:30 PM-Kevin Gillis of Northborough Realty Holdings, LLC-was present to discuss the Order of Conditions issued on October 16, 2007 for the property located on Emery Street, Bondsville.

K.Gillis asked the PCC to issue a new original OC preferable in the name of Northborough Realty Holdings, LLC since they are the new owners of the property.

Discussions were held regarding how to proceed.

M.Watson indicated that when the original OC was issued there does not appear to have the signature page in the file.

M.Watson stated that she would contact DEP to see if they would be able to fax over the original signature page.

The item would need to be discussed when the Chairman and Vice-Chairman are present at the next meeting on November 5.

Certificate of Compliance request from Gordon Richards-whose property is located on 384 Boston Road, Palmer.

A letter dated October 16, 2009 was received from Gordon Richards requesting the COC.

A motion was made by R.Ring to issue the Certificate of Compliance for 384 Boston Road.  M.Trybus seconded.  The vote passed (4:0).

Meeting Minutes of October 6, 2009-A motion was made by R.Ring to approve the minutes as amended.  M.Trybus seconded. The vote passed (4:0).

Dauphinais Land Donation-C.Beauregard prepared the report Vacant Land Located at Boston Road Rt. 67 Palmer to be Donated to the Town of Palmer by Dauphinais & Son, Inc.  This report has been forwarded to the Town Council to review.

C.Beauregard asked if this would be on the next Town Council agenda.

M.Watson stated that she would ask the Town Managers office if it would be on the agenda for October 26.

The PCC commended C.Beauregard for her preparing the report.

R.Ring stated that he and C.Beauregard attended a site visit at the property on October 12 along with Town Councilor Paul Burns.

John Lizak Enforcement Order-for the property located on Shearer Street, Palmer.

The PCC discussed the recent letter from Roger Woods dated September 21, 2009 and the conditions of the Enforcement Order II issued in January 2009.

The PCC determined that if the previous fines in the amount of $ 6600.00 were not paid to the town, they would not issue an extension.

R.Ring stated that the fine has not been paid, the site walk for the various planting location never occurred therefore; the PCC should not consider changing the timeline of the enforcement order conditions.

A motion was made by R.Ring to send a letter to John Lizak.  P.Izyk seconded.  The vote passed (4:0).

Knox Pond Construction Report #23-the PCC reviewed the report dated October 5 from Sherman and Frydryk for the property located on 1094 Thorndike Street, Palmer.

Letter from Town Manager-dated October 8, 2009 and signed by Matthew Streeter regarding the spending freeze.

A motion was made by R.Ring acknowledging receipt of the letter from the Town Manager.  C.Beauregard seconded. The vote passed (4:0).

Letter from Town Clerk-dated October 9 regarding all municipal employees and members of boards and commissions must complete the State Ethics Commission online training for Conflict of Interest Law Online Training Program.

Discussions were held regarding the changes to the state’s conflict of interest law.

A motion was made by R.Ring acknowledging receipt of the letter from the Town Clerk.  M.Trybus seconded. The vote passed (4:0).

The PCC reviewed the letters dated October 9 and October 16 from Lessard Environmental for the property located at 21 Wilbraham Street, Palmer.

The PCC discussed the upcoming meeting dates in November.

M.Watson stated that the first Tuesday is Election Day on November 3 and therefore the meeting for the PCC would need to be rescheduled.

The next meeting would be held on Thursday November 5.

M.Trybus discussed the former State Street dump indicated that there is trash that is too close to the wetlands.

This item would be tabled to the next meeting.

8:25 PM-A motion was made by R.Ring to adjourn.  M.Trybus seconded.  The vote passed (4:0).
