CONSERVATION COMMISSION MEETING
Meeting Minutes of Tuesday, April 21, 2009
Meeting Room #1- 7:00 PM
Chairman David Johnson called the meeting to order at 7:00 PM. Present were Commissioners Peter Izyk, Robert Ring, Donald Duffy, Matthew Trybus and Harry Johnson. Also present were Conservation Agent Sheryl Becker and Principal Clerk Mary Watson recording the minutes.
There were no public hearings scheduled.
Carl Bryant was present and had submitted a letter of interest dated April 13, 2009 for the vacancy position on the PCC.
Riverwalk Associates, LLC-for the permitted project located off Barker Street and Chudy Street, Three Rivers.
Neal Geary requesting an extension of the Order of Conditions issued on May 11, 2006 and submitted a letter dated April 8, 2009.
Barbara Jones, whose property is located on 174 Chudy Street, was present. Barbara asked the PCC if it is standard to request a three-year extension.
A motion was made by R.Ring to extend the permit to Riverwalk Associates, LLC for three years, with a new expiration date of May 11, 2012. H.Johnson seconded. The vote passed (6:0).
The PCC signed the Quaboag Valley Corporation Emergency Certification for the property located on Palmer Road, Three Rivers.
The PCC reviewed the letter dated April 15, 2009 and signed by Robert McCollum, Wetland Program Chief of the Department of Environmental Protection.
The letter states that the DEP received the Request for Determination of Applicability (RDA) that was submitted on December 2, 2009. DEP held an informal on-site meeting on April 9 at Meadowbrook Green Condominiums, located on 5 Meadowbrook Lane. At the meeting DEP determined and issued a Superseding Determination of Applicability.
Therefore, the applicant is required to submit a Notice of Intent for the use of herbicides for treatment of the pond.
Member Robert Ring submitted a letter to the PCC dated April 20, 2009. The letter states that the PCC should consider developing rules and regulations for the PCC acquired land.
Discussions were held regarding the rules and regulations and using money from the wetland fund to have All Terrain Vehicle (ATV) enforcement of the PCC land from the Palmer Police Station.
D.Duffy stated that there should be a log of the activity and time done by the police department.
R.Ring stated that he would make the necessary corrections to the document and present the information to the Town Manager for the town lawyer to review.
Meeting Minutes of April 7, 2009-A motion was made by H.Johnson to approve the minutes. P.Izyk seconded. The vote passed (6:0).
Carl Bryant, a commissioner on the Bondsville Fire and Water Department, stated his interest in the vacancy position on the PCC.
Carl stated that he has dealt with the Belchertown Conservation Commission and the DEP along with having experience in pesticide applications and a background in agriculture.
The PCC stated they would take the letter of interest from Carl Bryant under advisement.
Project News:
S.Becker stated that she spoke with Heather Comee of Pioneer Environmental. There has been no response from DEP regarding John Lizak’s Enforcement Order for the property located on Shearer and Thorndike Street. Once DEP responds then Pioneer Environmental would submit the Restoration Plan to the PCC.
D.Johnson stated he visited the JT Brown gravel site located on Ware Road and that there were no issues.
Wetland Bylaw Committee-R.Ring gave an update and stated that they are waiting for Chris Curtis of Pioneer Valley Planning Commission (PVPC) to provide additional language for the bylaw amendment. The information should be available at the next meeting held on May 5.
Knox Pond Construction Report # 17-A letter dated April 7, 2009 was sent by Keith Terry of Sherman & Frydryk Land Surveying and Engineering.
S.Becker stated that she had spoken to a representative from Heritage Home Carpentry regarding the property they own on West Warren Road. The potential buyer had been inquiring about the existing Order of Conditions.
P.Izyk stated that the letter from Riverwalk Associates, LLC has a clerical error and therefore would need to be resubmitted.
D.Duffy stated that many bags of trash had been taken off of Bacon Road. The PCC is waiting to hear from the Palmer Police Department regarding information found and enforcement that is needed.
R.Ring stated that the Historical Commission is interested in pursuing a memorial for Jane Golas at the Palmer Public Library.
8:10 PM-A motion was made by R.Ring to adjourn. H.Johnson seconded. The vote passed (6:0).
